Terms of Service (ToS)

1. Agreement to Terms

By registering for or using FolioBuild at foliobuild.co.uk (the “Service”), you (“User”, “you”) confirm that you have read, understood and agree to these Terms of Service (“ToS”) and our Privacy Policy. If you do not agree, please do not use the Service.

2. Service Description

FolioBuild provides an online platform that allows users to upload CVs, project documents, and related materials (“User Content”), and build a professionally-formatted portfolio based on that content. The Service will parse, store, display and manage such content as part of providing the portfolio functionality.

3. Eligibility & Account Responsibility

• You represent that you are at least 16 years old (or the minimum age required by laws in your country) and have the legal capacity to enter into these ToS.
• You agree to provide accurate and complete information when registering, and to keep your account credentials secure.
• You are responsible for all activity under your account.

4. User Content — Rights & Licence

“User Content” refers to any data or documents you upload (CVs, textual content, project files, images, etc.).

• By uploading User Content, you grant FolioBuild a non-exclusive, worldwide, royalty-free licence to store, reproduce, parse, display and otherwise process that content for the purpose of delivering the Service.
• You confirm that you have all necessary rights and permissions for any content you upload; the content does not infringe third-party rights, is lawful, and does not violate these ToS.
• Public Portfolios: You acknowledge that if you choose to publish your portfolio, it will be publicly accessible. You are solely responsible for any personal data or sensitive information you choose to make public. We recommend you do not publish private contact details (like home addresses) or sensitive personal data.
• You retain ownership of your User Content.

5. Acceptable Use / Prohibited Conduct

You must not use the Service to:

• Upload content that is unlawful, infringing, defamatory, hateful, discriminatory, or otherwise objectionable;
• Attempt to gain unauthorised access to the Service or other users’ accounts;
• Use the Service in a way that violates applicable laws or regulations.

We reserve the right (but are not obliged) to remove or refuse to display any User Content that violates these ToS or is otherwise objectionable.

6. Data Protection & Privacy

We handle personal data in accordance with our Privacy Policy (see below). By using the Service you consent to the collection, processing, storage and transfer (as described) of your personal data.

7. Intellectual Property & Platform Rights

• You own your User Content.
• FolioBuild retains all rights, title and interest in the underlying platform, software, branding, and any derivative materials created by the platform (excluding your User Content).
• You may not copy, reproduce, reverse engineer, modify, or redistribute the platform software or any derivative, without our express written permission.

8. Limitation of Liability & Disclaimers

The Service is provided “as is” and “as available.” We make no warranties, whether express or implied (e.g. accuracy of parsing, uptime, suitability for a particular purpose).

To the fullest extent permitted by law, FolioBuild (and its owners, employees, affiliates) are not liable for indirect, incidental, consequential or punitive damages arising from your use (or inability to use) the Service, or from any content loss.

9. Indemnification

You agree to indemnify and hold harmless FolioBuild (and its officers, directors, employees and agents) against any losses, liabilities, damages, claims or expenses (including legal fees) arising from your use of the Service, or your breach of these ToS.

10. Termination & Account Deletion

You may delete your account at any time by contacting support (sup.foliobuild@gmail.com) or via an account-settings option (if implemented).

We may suspend or terminate your account or access if you breach these ToS or for other lawful reasons.

Upon deletion or termination, we may delete or anonymise your User Content per our data retention / deletion policy (see Privacy Policy).

11. Changes to Terms

We may update these ToS from time to time. We will notify users of material changes (e.g. via email or notice on dashboard). Continued use after changes constitutes acceptance.

12. Governing Law & Dispute Resolution

These ToS are governed by the laws of England and Wales. Any dispute arising under or in connection with these ToS shall be subject to the exclusive jurisdiction of the courts of England and Wales.
